Magistrates, District & Supreme Courts

The Magistrates, District & Supreme Courts have a wide jurisdiction to hear both civil and criminal matters.

Civil matters are proceedings where an individual or company sues another individual/s and/or company/ies usually to obtain some sort of compensation for harm done by the individual/s and/or company/ies being sued. Often such matters involve claims for damages, being a sum of money, but this is not always the case. One can also sue for performance of a contract, return of property, declarations that a person holds an interest in property among other things.

The Court that one commences a civil proceeding in, depends on the specific type of proceeding and/or the amount of money claimed as part of the proceeding.

There are various Court locations throughout Queensland and the circumstances of an individual’s particular situation will determine which location your civil claim or application needs to be filed in.

The type and/or value of your civil claim will also determine the amount of the filing fee payable to lodge your proceeding in the Court.
